Clarification: Harry Tulugak

A recent judgment by the Quebec Superior Court did not concern a “sexual harassment case” involving Mr. Harry Tulugak, contrary to the impression which may have been created by the headline of an article published in the Sept. 29, 2006 edition of Nunatsiaq News.

The case only concerned Mr. Tulugak’s application to the court to be reinstated as member of the Board of Directors of the Innulitsivik Health Center after he had been removed from office in a manner which he alleged was illegal.

In addition, the article’s summary of the evidence heard in court may have given some readers the impression that the judge accepted the testimony of one of the complainants. In fact, the judge who heard the matter was not required to rule whether Mr. Tulugak had sexually harassed anyone, nor did the judge make any such finding.

The court decided that the Chairman of the Board of the hospital acted legally and fairly in removing Mr. Tulugak from office. Mr. Tulugak has appealed that decision.
